By using worldfilmcollective.com and the WFC on-line communities (including but not limited to WFC on YouTube, WFC on MySpace and any WFC on-line message boards or other WFC community sites or services) (“the WFC Communities”) you agree to be legally bound by these Terms and Conditions, which shall take effect immediately on your first use of worldfilmcollective.com or the WFC Communities. If you do not agree to be legally bound by all of the following terms please do not access and/or use worldfilmcollective.com or the WFC Communities.
WFC reserves the right to change these Terms and Conditions at any time by posting alterations online. Please review these Terms and Conditions regularly to ensure you are aware of any changes made by WFC. Your continued use of worldfilmcollective.com and the WFC Communities after changes are posted means you agree to be legally bound by these Terms and Conditions as updated, amended or modified. 1. 1.1 You may view and use World Film Collective films in accordance with the WFC Creative Commons Licence the full detail of which can be found at worldfilmcollective.com.
1.2 You agree to use worldfilmcollective.com or the WFC Communities only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of worldfilmcollective.com or the WFC Communities. Prohibited behaviour when using worldfilmcollective.com and WFC Communities includes harassing or causing distress or inconvenience to any person, transmitting or uploading any information or material that’s disrupts the normal flow of dialogue within worldfilmcollective.com or the WFC Communities, or that breaches any law, whether criminal, tortious or otherwise or that is offensive, threatening, defamatory, vulgar, obscene, harassing, false, misleading, or unreliable. This clause 1.2 is in accordance with the WFC Community Rules at clause 4. 2. Intellectual Property
2.1 The names, images and logos identifying WFC or third parties and their products and services are subject to copyright, design rights, trade marks or other intellectual property rights of WFC and/or third parties. Nothing contained in these terms shall be construed as conferring by implication or otherwise any licence or right to use any trade mark, patent, design right, copyright or other intellectual property right of WFC or any other third party. 3. Contributions to worldfilmcollective.com
3.1 Where you are invited to submit any contribution to worldfilmcollective.com or a WFC Community (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to adhere to the Terms and Conditions of WFC’s Creative Commons Licence. Any personal information submitted by you will be treated in accordance with the WFC Privacy Policy. If you do not want to grant to WFC the rights set out in the Creative Commons Licence or Privacy Policy, please do not submit your contribution to worldfilmcollective.com.
3.2 By submitting your contribution to worldfilmcollective.com or a WFC Community you warrant that your contribution:
3.2.1 is your own original work and that you have the right to make it available to WFC for all the purposes specified in WFC’s Creative Commons Licence; and
3.2.2 is not defamatory; and
3.2.3 does not infringe any law whether criminal, tortious or otherwise; and
3.2.4 complies with the WFC Community Rules at clause 4 below.
3.3 By submitting your contribution to worldfilmcollective.com or the WFC Communities you agree to indemnify WFC against all legal fees, damages and other expenses that may be incurred by WFC as a result of your breach of the above warranty. 4. worldfilmcollective.com Community Rules
4.1 You agree to use worldfilmcollective.com and the WFC Communities in accordance with the following Community Rules. These rules apply to worldfilmcollective.com and the WFC Communities. You should, however, read the local house rules of the particular site or service you are using, as there may be some local variations to these Community Rules.
4.2 About your posts:
4.2.1 Your contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing harm or trouble.
4.2.2 You must not contribute information or material (including but not limited to your user name(s)) that breach any law, whether criminal, tortious or otherwise, or that is offensive, threatening, defamatory, vulgar, obscene, harassing, false, misleading, profane, sexually oriented, racially offensive or otherwise objectionable.
4.2.3 If you use multiple logins for the purpose of disrupting worldfilmcollective.com or the WFC Communities or annoying other users, WFC may take action against you including the termination of your WFC accounts and/or WFC membership.
4.2.4 Using your access to worldfilmcollective.com or WFC Communities to send unsolicited bulk mail or spam to other users; or place material on the internet, worldfilmcollective.com or to WFC Communities for your own business or commercial purposes is forbidden.
4.2.5 You may refer to specific URLs (web site addresses) unless forbidden from doing so under the relevant local house rules. However, we do not endorse, nor control any websites referred to at worldfilmcollective.com or WFC Communities. We are not responsible for the content, Privacy Policy or security of such other websites.
4.2.6 Deliberate and unjustified misuse of the complaints facilities offered by worldfilmcollective.com or WFC Communities is not permitted. If you persist in misusing the complaints facility, action may be taken against you by WFC including the termination of your account(s) and WFC membership
4.2.7 You agree to only contribute materials to worldfilmcollective.com or WFC Communities in which you retain all the necessary ownership rights and intellectual property rights and that do not infringe any third party rights (including rights of privacy or rights of publicity), unless you have permission or a licence from the owner(s) to contribute the material to worldfilmcollective.com or WFC Communities. 5. Safety
5.1 Subject to these Terms and Conditions and this clause 5.1 we advise that you must never reveal any personal information about yourself or anyone else when using the worldfilmcollective.com website and/or WFC Communities except information requested by WFC in order to provide WFC services. We strongly advise that you do not include postal addresses of any kind in the information you post to worldfilmcollective.com or WFC Communities.
Any personal information provided by you to WFC (and for the avoidance of doubt this does not include material posted by you for public display to worldfilmcollective.com or WFC Communities or material shared by you with other users of worldfilmcollective.com or WFC Communities) will be treated in accordance with the WFC Privacy Policy. Such personal information may include your name, title, telephone number(s), home address, work address, email address, job title and organisation you are employed by.
5.2 The views expressed on or at worldfilmcollective.com or WFC Communities are those of members of the public and are not necessarily those of WFC. 6. If you are under 16
6.1 If you are under 16 please obtain a parent’s or guardian’s permission before taking part in any worldfilmcollective.com discussion.
6.2 You are strongly advised to not reveal any personal information about yourself or anyone else when contributing material to worldfilmcollective.com or WFC Communities (for example, your telephone number, home address or email address). 7. If you breach these Terms and Conditions
7.1 If you fail to abide by these Terms and Conditions (and/or any variations in the relevant local house rules) when using worldfilmcollective.com or WFC Communities, you will be sent an e-mail informing you (if applicable) that your contribution has failed or has been edited. This e-mail may also include a warning that continuing to breach these Terms and Conditions may result in action being taken against your WFC accounts.
7.2 WFC reserves the right to suspend or terminate your access to the worldfilmcollective.com website or WFC Communications if materials posted by you are deemed by WFC to be in breach of these Terms and Conditions including the WFC Community Rules.
7.3 WFC reserves the right to edit, or require you to edit, material posted by you on worldfilmcollective.com or WFC Communities.
7.4 If your access to worldfilmcollective.com or WFC Communities is suspended or terminated for any reason, you must not attempt to re-register or access the services which you have been suspended from without WFC’s prior written consent. 8. General
8.1 If there is any conflict between these Terms and Conditions and specific terms appearing elsewhere on worldfilmcollective.com (including local house rules) then the latter shall prevail.
8.2 If any of these Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these Terms and Conditions and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
8.3 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales and all disputes arising from or in relation to these Terms and Conditions will be submitted to the exclusive jurisdiction of the English Courts.
